Too much income for a chapter 7 bankruptcy, but too much debt for a ch. 13. Please help!?
My husband and I live in Oregon, and need to file for bankruptcy. we had a small business that didn't make it, and personally signed for some of the debt incurred. we contacted an attorney who said that we passed the means test because my husband was on unemployment for several months, but because of his new job and the income that comes with it, we may not qualify for a chapter 7 bankruptcy. we were also told that we have too much unsecured debt because of the business to file a chapter 13.
To get the job my husband now has, he had to move 4 1/2 hours away and will need to rent someplace down there. we own a house that my kids and I are staying at until we are sure that the job works out for him (it's a car dealership and we're afraid it may go away since car sales are so slow. we wouldn't normally have taken a job so far away, but couldn't find anything around where we live)
My question is, since he had to move to get a job, can we include our mortgage on our house and the place down south that my husband will have to rent as monthly expenses? If we can include both residences, (which we really do have to pay) we have negative cash flow and can file the chapter 7. If we can't, I don't know what to do.
Any advice would be great, as this whole thing is just awful!

My husband & I were just about in the same boat as u r 8 years ago but we got financial help with paying our bills through an organization call "CCCS" it stands for Consumer Credit Counseling Service, they sit down with u & go over all your bills, income, assets, secure loans & unsecured loans, they contact your creditors & make arrangements for monthly payment. This is sent to them by CCCS each month all u do is give what ever you & CCCS come up with each month to CCCS, u no longer have to deal with any nasty letters or phone calls cause CCCS handles them all. It is a free service & I don't know what we would have done without them.
Liquidate all assets and move to Mexico. If you're not into burritos and donkey shows you could go further south, Brazil is nice. If you really need a place to hide out, Venezuela doesn't extradite criminals to the US (I've got a criminal friend who owns property down there so he's got a place to run to) If you don't want to live in South America you could try Asia or Africa, but there's a remarkably high chance of contracting SuperAIDS there. Europe is nice, but western europe (the nice ones, France, England, Germany, Spain, etc) all extradite. Eastern Europe is decent, not too much SuperAIDS but a lot of crime.
