I have been paying on a chapter 13 for three years. my truck creditor was included as a "priority creditor". the secured portion of the debt has been paid. however, an unsecured portion still exists. still, the creditor will not send me the title until the chapter 13 is discharged two years from now. This wouldn't normally be a big deal, but the truck is in dire need of repairs ($1000+) of which I can not afford. I have had offers to buy the truck or trade it for something that is actually more affordable (and runs!). I have spoken with my trustee and they advised me to speak with the creditor and/or my lawyer. I spoke with the creditor and they advised me to speak with my lawyer. I am having problems reaching my lawyer. what actions can I take to get my title? If and when I get my lawyer, what action is he likely to suggest?

I live in Oklahoma and am married but have been living apart from my husband for several years with my daughter and have been filing head of household on my tax returns. You can file chapter 7 seperately. it might appear on his credit though because you are legally married.

Filing bankruptcy is not an easy process and there are lots of forms to be filed and do it on your own has always some missing factors… not sure your situation would allow this, but you might better talk to the lawyer or accountant, I know it will cost but better do it now than ending up paying more..

We filed Capter 7 Bankruptcy and it was granted in February. We still have the house loan and car loan place calling us and also sending us statements. I figured it was an overlap in getting the message to their departmrents. is this normal?
Also, we gave up our boat and the lawyer said they had 30 days( from that date – Declared bankruptcy) to pick it up and they did not. Now it is April and we get a letter from the lawyer saying we still need to give up the boat in 30 days. We are confussed and dont understand what is going on?

I am the middle child of a 3 siblings and possibly am the most concerned about us losing our home (sounds a bit overwhelming doesn't it?). After my parents divorced, we lost a lot of money towards the mortgage payments and the recession didn't help much either. my parents were both uneducated and work was hard to come by so we were lucky if we made $800 a month at the most. we lost the house but were living in it rent free for about 1 1/2 years until they could find someone to buy it. we searched for houses in the area (but unfortunately, they were all too expensive) and moving to another town was out of the option because my mom wanted to keep us in the schools we were in. I read on a couple of websites of options we could take to save our home (keep in mind that it is already foreclosed, but we haven't been evicted until it's bought). I read about Chapter 7, Chapter 13, filing for bankruptcy and a whole bunch of other steps we could take but I'm not sure which one we should do.

Could someone provide information on each one of the above listed (and any others you think might help save our home). And which one sounds like it could help our family in this situation the most?

You are going to have to move. That will be more difficult if your parents file for Bankruptcy before the move. You should try to move before you are served an eviction notice as that also makes it very hard to rent any housing.

Your parents need to contact a social services agency and see if there is any Sec. 8 help available. if not, you may need to seek a shelter until your parents can find something they can afford. Staying in that community may not be an option.

"Bankruptcy" is a reorganization of your debt, it doesn't somehow magically "make it go away"! the court will decide what you must pay to whom and when you must pay it…

Anyone you list as a debtor will be included. even secured loans can be included, but you will likely need to forfeit the security…

What is the car exemptions for chapter 7 bankruptcy in ohio?
i keep getting conflicting information. my car was paid off in full on one of the credit cards i am filing bankruptcy on. so i own it outright. it is my only car, it has a value of 7-8500 depending who you ask. if i filed 7 could i keep my car? obviously i would rather file 7 then 13.
