Chapter 13 – How do I get my title?
I have been paying on a chapter 13 for three years. my truck creditor was included as a "priority creditor". the secured portion of the debt has been paid. however, an unsecured portion still exists. still, the creditor will not send me the title until the chapter 13 is discharged two years from now. This wouldn't normally be a big deal, but the truck is in dire need of repairs ($1000+) of which I can not afford. I have had offers to buy the truck or trade it for something that is actually more affordable (and runs!). I have spoken with my trustee and they advised me to speak with the creditor and/or my lawyer. I spoke with the creditor and they advised me to speak with my lawyer. I am having problems reaching my lawyer. what actions can I take to get my title? If and when I get my lawyer, what action is he likely to suggest?
